Terms and Conditions

Welcome to SwimIntel, a software-as-a-service platform provided by SwimIntel, LLC, available at https://swimintel.com and https://swimintel.al (together, the “Websites”). These Terms and Conditions (“Terms”) govern your use of our websites, platform, and services (collectively, the “Services”). By accessing or using SwimIntel, you agree to these Terms.

If you do not agree with these Terms, you must not use the Services.

1. Acceptance of Terms

By using our Services, you confirm that you are at least 14 years old. Only athletes aged 14 or older may create or claim a profile. If you are under 18, you represent that you have the permission of a parent or legal guardian to use the Services. If you are entering into these Terms on behalf of an organization (e.g., a school, club, or business), you represent that you have authority to bind that entity to these Terms.

2. Athlete Profiles and Data

a. Profile Creation and Claiming

We may create initial athlete profiles by seeding publicly available competition results and other sources of swimming data. These profiles may contain errors or omissions. Athletes or their parents/guardians may claim or create profiles and update or correct information, including event times and biographical details.

b. Accuracy of Data

We strive for accuracy but do not guarantee that any data or times are complete or correct. It is the responsibility of the athlete or guardian to review and correct the information in their profile. SwimIntel is not liable for inaccuracies.

c. Profile Images and User Content

Athletes may upload a profile image and other content (“User Content”). You represent that you have all necessary rights to such content and that it does not infringe any third-party rights or violate any law. By uploading, you grant SwimIntel, LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and otherwise use the content solely to operate and provide the Services. We may remove content that is inappropriate, unlawful, or infringes rights at our discretion.

d. Scout Reports and Video-Based Analysis

SwimIntel may offer written evaluations and related features known as “Scout Reports” as part of the Services, including as a paid add-on and/or as Scout Reports created proactively for certain athlete profiles. Scout Reports may be based on race footage, meet video, other audiovisual content provided by you or linked by you, and/or publicly available performance data.

Consent and Visibility. By using the Services, you authorize SwimIntel to create Scout Reports related to the athlete profile you control (or that relates to you) and to display Scout Reports to: (i) the athlete who owns or claims the profile, and (ii) authorized college coaches and other authorized users on paid tiers as determined by SwimIntel. Scout Reports are not intended to be publicly visible to the general public unless SwimIntel states otherwise.

Video Rights and Permissions. If you submit, upload, link, or otherwise provide access to any race footage or other video for Scout Report analysis, you represent and warrant that you have the rights and permissions necessary to provide such content to SwimIntel for analysis and for the creation and display of derivative written evaluations as described in these Terms. You acknowledge that certain videos may be owned by third parties (for example, meet operators, broadcasters, or clubs), and you agree not to provide video that you do not have rights to share for these purposes.

Opt-Out and Removal Requests for Proactive Scout Reports. If SwimIntel creates a Scout Report proactively, the athlete (or parent/guardian if the athlete is under 18) may request that SwimIntel remove the Scout Report from the athlete’s profile by contacting support@swimintel.com. SwimIntel will take reasonable steps to honor valid removal requests within a reasonable time, subject to legal obligations, dispute preservation, and internal record-keeping needs.

3. Data Sharing and Privacy

a. Optional Sharing with Coaches and Sponsors

Athletes may opt in to share their contact information and “About Me” profile details with verified college coaches and/or NIL brand sponsors. If you opt in, that information will be visible to authorized third parties using the Services.

b. Third-Party Use

College coaches and NIL brand sponsors may use shared information for recruiting, sponsorship, or related purposes. SwimIntel does not control and is not responsible for third-party actions once information is shared at your direction.

4. Ownership of Data

All platform software, rankings, analytics, Scout Reports, written evaluations, report formats, methodologies, and other information provided through the Services are the property of SwimIntel, LLC. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, educational, or organizational purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from our software, data, rankings, analytics, or Scout Reports without our prior written consent.

Prohibition on AI Training and Derivative Use. Except as expressly authorized in writing by SwimIntel, LLC, you may not use any data, content, rankings, analytics, Scout Reports, outputs, or other information made available through the Services (including athlete profiles, aggregated data, or derived insights) for the purpose of training, fine-tuning, validating, or operating any machine learning model, artificial intelligence system, algorithmic model, or similar technology. This prohibition applies regardless of whether access to the information is obtained manually, programmatically, via automated means, or through normal use of the Services, and regardless of whether the resulting model or system is offered commercially or non-commercially.

5. Subscriptions and Payments

a. Plans and Billing

SwimIntel operates on a tiered subscription model. By subscribing, you agree to pay the fees associated with your chosen plan. Subscription fees are charged in advance on a recurring basis as specified during signup (e.g., monthly or annual). Plan features and limits may vary by tier.

b. Automatic Renewal Authorization

All paid subscriptions automatically renew at the end of the applicable billing period unless canceled prior to the renewal date.

By providing a payment method and completing a subscription purchase, you expressly authorize SwimIntel, LLC to charge the payment method on file for the applicable renewal term at the then-current subscription rate, plus any applicable taxes, unless you cancel before renewal. Automatic renewal continues until the subscription is canceled by the account holder.

c. Renewal Notices and Method of Notice

SwimIntel provides advance notice of upcoming subscription renewals by email to the email address associated with the account. Renewal notifications are typically sent approximately 30 days, 7 days, and 2 days prior to the renewal date.

You acknowledge and agree that (i) the email address associated with your account is the primary method of renewal notice, (ii) renewal notices sent to that email address constitute sufficient and effective notice, and (iii) failure to open, read, receive, or review renewal notices does not invalidate the renewal or entitle you to a refund except as expressly stated in these Terms.

d. Responsibility for Account Email; Use of Minor or Third-Party Emails

You are solely responsible for ensuring that the email address associated with your account is accurate, accessible, and actively monitored.

If you choose to register an account using an email address belonging to a minor, dependent, or another third party, you acknowledge and agree that you remain fully responsible for all subscription charges, renewals, and account activity, and that SwimIntel is not responsible for missed notices resulting from the use of an email address not directly controlled by the paying account holder.

For accounts associated with athletes under the age of 18, the parent or legal guardian who provides payment information is deemed the account holder and is fully responsible for all fees, renewals, and subscription management, regardless of which individual’s email address is associated with the account.

e. Cancellation

You may cancel your subscription at any time prior to the renewal date through your account settings or by contacting SwimIntel support at support@swimintel.com. Cancellation prevents future charges but does not retroactively refund any fees already paid for the current billing period.

f. Taxes and Changes

Fees are exclusive of applicable taxes, which you are responsible for paying. We may change plan prices and features prospectively by posting updated information or providing notice as required by law.

g. Refund Policy

Refunds are available only if requested within 24 hours of the charge being posted. After this period, all charges are non-refundable. Refunds are not provided for subscription renewals resulting from failure to cancel prior to the renewal date, including cases where renewal notices were sent but not reviewed.

To request a refund (if eligible), contact support@swimintel.com with your payment details and reason for the request.

h. Scout Reports Add-On; Disclaimers

SwimIntel may offer Scout Reports as an add-on service for athletes and may also create Scout Reports proactively for certain athlete profiles. Fees (if any) for Scout Reports will be disclosed at the time of purchase. Scout Reports may be delivered within the Services and may be updated, revised, or removed from time to time.

Scout Reports Are Opinions, Not Guarantees. Scout Reports reflect subjective analyst observations based on limited information (for example, available race footage and performance data) at the time of review. Scout Reports are provided for informational and recruiting context only and are not recruiting recommendations, guarantees of performance, or predictions of collegiate placement, scholarships, roster status, or recruiting outcomes. Coaches and other users are responsible for conducting independent evaluation and assessment.

No Reliance. You agree that SwimIntel is not responsible for recruiting decisions or outcomes, and you will not rely on Scout Reports as the sole basis for decision-making. SwimIntel does not warrant that Scout Reports are complete, accurate, or current, and Scout Reports may not reflect an athlete’s full training history, health status, or competitive profile.

Removal Requests for Purchased Scout Reports. Athletes (or their parent or legal guardian if under 18) may request removal of a purchased Scout Report from public or coach-visible portions of the Services. Removal of a Scout Report does not entitle the user to a refund unless otherwise expressly stated, and SwimIntel may retain internal copies of Scout Reports for record-keeping, quality assurance, and legal purposes.

6. Prohibited Use

You agree not to:

  • Use the Services for any illegal, harmful, or unauthorized purpose; upload content that is defamatory, obscene, infringing, or otherwise unlawful.
  • Access, scrape, harvest, collect, extract, index, or otherwise use any portion of the Services, including athlete profiles, rankings, analytics, Scout Reports, or other data, whether by automated means, manual processes, or otherwise, for the purpose of: (i) creating datasets, (ii) training, fine-tuning, or validating artificial intelligence or machine learning models, (iii) developing or improving competing products or services, or (iv) republishing, redistributing, or commercially exploiting such data outside the Services, without SwimIntel’s prior written consent.
  • Use the Services or any data obtained from the Services, directly or indirectly, to build, benchmark, train, or support a product, service, or model that competes with or is intended to compete with SwimIntel.
  • Reverse engineer, decompile, or attempt to extract the source code of SwimIntel’s software, rankings, analytics, Scout Reports, or methodologies.
  • Share, resell, or sublicense access to the Services (including coach access or Scout Reports) without our express written permission.
  • Misrepresent your identity or affiliation, or attempt to claim a profile you are not authorized to manage.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access at support@swimintel.com.

8. Modification of Services

We may modify, suspend, or discontinue the Services (or any part of them) at any time with or without notice. SwimIntel is not liable for any disruption or loss caused by such modifications.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without any warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Rankings, Analytics, and Scout Reports Disclaimer. Rankings, ratings, analytics, and Scout Reports are opinions and estimates based on available data and methodologies that may change over time. They are provided for informational purposes only and are not guarantees of future performance, recruiting outcomes, or results.

10. Limitation of Liability

To the fullest extent permitted by law, SwimIntel, LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. If your account is terminated, you remain bound by these Terms for any prior use of the Services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

13. Changes to Terms

We may update or modify these Terms at any time. Changes are effective when posted on the Websites. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

15. Profile Removal and Data Deletion

Athletes (or their parent/guardian if under 18) may request that SwimIntel delete their profile and associated personal information. Upon receiving such a request at support@swimintel.com, we will take reasonable steps to remove the profile and associated information from our Services, subject to any legal or regulatory obligations to retain certain data.

16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SwimIntel, LLC and its officers, directors, employees, contractors, agents, licensors, and affiliates from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Services or violation of these Terms;
  • Your User Content (including profile images, race footage, or other content you upload, submit, or provide), including any allegation that such content infringes or misappropriates the rights of a third party;
  • Your interactions with, or information shared with, any third party through the Services (including college coaches, NIL brand sponsors, schools, clubs, or recruiters);
  • Any actual or alleged violation of law, regulation, or the rights of any third party by you or by anyone using your account.

SwimIntel reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

17. Dispute Resolution; Arbitration; Class Action Waiver

a. Informal Resolution First

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at support@swimintel.com. If we cannot resolve the dispute within 30 days, either party may pursue a claim as described below.

b. Binding Individual Arbitration

Except as provided in Section 17(c), any dispute, claim, or controversy arising out of or relating to these Terms or the Services (including formation, performance, breach, termination, enforcement, interpretation, or validity) shall be resolved by binding arbitration on an individual basis and not in court.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or, if applicable, the Commercial Arbitration Rules). The Federal Arbitration Act and federal arbitration law apply. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement.

Arbitration may be conducted by telephone, videoconference, written submissions, or in person in Davidson County, Tennessee, unless the parties agree otherwise or applicable rules require a different location.

c. Exceptions

Either party may bring a claim in small claims court if it qualifies, or seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

d. Class Action Waiver

You and SwimIntel agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, representative, private attorney general, or consolidated proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.

e. Opt-Out

You may opt out of the arbitration and class action waiver provisions of this Section 17 by sending an email to support@swimintel.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your name and the email address associated with your account. If you opt out, neither you nor SwimIntel can require the other to participate in arbitration.

f. Severability

If any portion of this Section 17 is found unenforceable, the unenforceable portion will be severed and the remainder will be enforced to the fullest extent permitted by law.

By using SwimIntel, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
